Terms of Service and User Agreement

The following User Agreement governs the use of PIERCING.COM Ltd.’s (“PIERCING.COM”) webpage including its guest book, forums, and other services. PIERCING.COM is solely responsible for its content made available to the user. PIERCING.COM as provider of contents for use, is by law responsible for the content. PIERCING.COM issues no warranty as to the safety, reliability, accuracy, completeness, suitability or quality of the provided information. In case of material or ideological damages that were caused by utilization or the lack of precaution when using the provided material respectively the use of damaged or incomplete information, PIERCING.COM is not liable or responsible and cannot be held accountable unless intentional and negligent cause is proven. PIERCING.COM reserves the right to edit, review, move or delete partial or complete information or to temporarily or definitely shut down its publication, without notice.
- Links
On its server PIERCING.COM provides links to other WebPages that are maintained by third parties. The content of these WebPages are not in any way maintained by PIERCING.COM nor do they represent PIERCING.COM’s opinion. PIERCING.COM does not endorse, support, influence, encourage, verify or agree with comments, opinions and statements posted on third-party WebPages, particularly in case the user of third-party WebPages perceives any content as objectionable or offensive.
PIERCING.COM is only the provider of access to the above-mentioned WebPages. PIERCING.COM stresses the fact that PIERCING.COM has by no means any influence on the presentation or the content of the WebPages. It only provides the link and does therefore not undertake any liability for the content, correctness and lawfulness of the WebPages that are maintained and published by a third party.
PIERCING.COM distances itself from any published content of third party WebPages and does not use any of their content for its own purposes.
PIERCING.COM declares hereby that at the point of publication of links for WebPages maintained by a third party no illegal content was part of the third part webpage publication. PIERCING.COM does not have any influence on actual and future structure or content of third part WebPages.
The above-mentioned restriction and regulations apply to all links published within the Internet offer in addition to third party entries in guest books and discussion forums.

PIERCING.COM obeys any copyright and trademark laws for any publication, graphics, audio or video clips that are being used. PIERCING.COM tries to use its own publications, graphics, sound documents and video clips whenever possible. All text, graphics and multimedia content available from other sites are protected by copyright and trademark rights and are licensed to their particular owner. All text, graphics and multimedia content published by PIERCING.COM are the property of PIERCING.COM and are protected by copyrights that are controlled and owned by PIERCING.COM. Graphics, Sound files, video clips or text from this site may not be copied, reproduced, republished, uploaded or distributed in any way without PIERCING.COM’s permission.
- Guidelines for services
PIERCING.COM offers a variety of several different services through the Internet. The provided services differ depending on their nature and purpose. For use of these services the following rules and regulations apply:
The user agrees not to use the service for any illegal or inappropriate purposes or any purpose that would violate the User Agreement.
PIERCING.COM does not make any membership data (member name or password) available to others.
If you have reason to believe that your account is no longer secure, due to a lost or stolen password or user information, the password has be changed immediately. In case the password cannot be changed please contact PIERCING.COM at ONLINE@PIERCING.COM .
- Free Email service
Emails send or received through this service or any messages stored on the server cannot be checked for their content or nature as prohibited by law. Therefore it is not technically possible to check for any viruses, illegal and/or objectionable information. Source and sponsor (e.g. powered by www.PIERCING.COM.de) can be added to every message, as well as other information.
The member agrees to the following terms and regulations regarding email:
a) The email address may not be used for distribution of any illegal or obscene material;
b) To obey laws regarding the protection of children;
c) Respect the privacy of others and refrain from using defamatory, abusive, harassing or hateful language;
d) Do not use programs that might change or influence the physical or logic structure of the server and services.
The use of the email service for mass emails (spamming), junk mail, mail bombing and any other form of unauthorized advertising is strictly prohibited. The user agrees to use the email service for lawful purposes only and failure to do so and damages caused by the use of any above-mentioned violations are the user’s responsibility.
- Availability of memory space for private homepages and pictures
As part of the profile page the user receives community memory space for his/her personal information and pictures. PIERCING.COM does only provide access to the memory space and is by no means responsible for the content. PIERCING.COM does not have any control over the material that is posted on the individual user’s memory space. However, in case of the user’s failure to follow these rules and regulations PIERCING.COM reserves the right to suspend or terminate the user’s access without notice. PIERCING.COM does not guarantee access and availability of the email and Internet service at all times.
PIERCING.COM is not liable for any damages resulted from loss of access, loss of information or temporary cancellation of the service.
The user is responsible for controlling and securing the user’s data. Every user is responsible for complying with the current laws and regulations. The following regulations apply:
a) Use of copyright and trademark material without permission of the owner is strictly prohibited. Music or software material owned and protected by copyright and trademark laws may not be downloaded or copied without the owner’s permission.
b) Use of unauthorized advertising is strictly prohibited.
c) Distribution of illegal material is strictly prohibited.
d) Distribution of pornographic material is strictly prohibited
e) Material that encourages conduct that would constitute a criminal offense is strictly prohibited;
f) Defamatory, hateful or harassing material is strictly prohibited.
The user is not allowed to provide access to the memory space to third parties or to allow a third party to use the profile gallery page for their purposes. By posting pictures on the user’s profile page and PIERCING.COM’s server the user agrees to give PIERCING.COM international, free of charge, non-exclusive right to use, copy, transmit, display, collect and distribute these pictures. The right to do so is limited to the purpose of publishing and maintaining the user’s profile on PIERCING.COM’s server.
- Surveys, chat rooms, conferences and personals
Use of etiquette and respect for others guarantees functioning communication between PIERCING.COM and its users and an optimal use of PIERCING.COM’s services. Users of PIERCING.COM’s services are prohibited to use hurtful, defamatory, harassing, abusive, obscene, racist or other illegal language in PIERCING.COM surveys, chat rooms, conferences or personals. The users agree to respect other user’s cultural and religious differences and opinions. PIERCING.COM’s profile und gallery pages are meant to give individuals a space to voice their opinion, form an opinion and get to know other users. In addition, unauthorized advertising or any other form of commercial use is prohibited.
PIERCING.COM reserves the right to delete or deny access to any user’s profile pages violating the general user agreement.
Any information, identities and statements made by other users and posted on PIERCING.COM’s user pages may be false. PIERCING.COM does not ensure rightful conduct of third parties. PIERCING.COM is not liable for any information or data handled by third parties or any information that was made available to a third party.
- Data security
PIERCING.COM is interested in their user’s protection of privacy and their private data and would like users to feel comfortable with PIERCING.COM’s service. Personal data is only stored if the Internet user provides information in the course of registration for the community. Data protection laws and regulations apply.
- Legal effect of this document
This document is to be seen as part of PIERCING.COM’s Internet service. In case parts of this text do not apply partially or completely to current laws and regulations, the remaining parts of the text do still apply.
